Helpful ‘Do & Don’t” tips.
If you are stopped for questioning…
DO:

- Give your name and information on your ID or Driver’s License
- Remember you have the right to remain silent
- Show ID
- Ask police to see a search warrant
- Make sure the officer knows you do not agree to be searched
- Ask if you are free to leave
DON’T:
- Disrespect officer
- Refuse to give your name
- Agree to be arrested
- Run away or physically resist
- LIE
- Discuss your citizenship or immigration status
If you are stopped in your car…
DO:
- Show your license, registration and proof of insurance
- Keep your hands on the wheel
- Make it clear that you do not agree to have your car searched
- Sign ticket if you are given one
- Take blood, urine, or breath test
- Keep your car clear of unnecessary objects
DON’T:
- Physically resist a search, but make it clear you DO NOT AGREE TO SEARCH
- Refuse to sign a ticket
- Search for license or registration until asked
- Refuse blood, urine or breath test
- Disrespect officer
- Attempt to bribe
- Play music loudly
- Have any objects hanging from your rearview mirror
If you are arrested or taken to a police station…
DO:
- Tell the police your name and basic identifying information
- Tell police you want to remain silent and want to talk to a lawyer
- Ask if you can park your car in a safe place
- Make sure you get your 3 phone calls
- Memorize phone numbers for three family members or friends
- Assume the police are recording your calls
DON’T:
- Give them any information except for your name and basic identifying information
- Give explanations
- Talk without a lawyer
- Talk about your case on the phone
- Forget the fact that if you cannot afford an attorney, one must be provided to you.
- Make any decisions in your case without your lawyer
- Explain your defense in the police station
- Discuss your immigration status
Whether you are released or remain in jail, once given a court date…
DO:
- Remember that you have the right to an attorney
- Ask the judge if you can be released without bail
